Terms of Service
Last updated: October 9, 2026
1. Who we are and what this agreement covers
Bluebelly (“Bluebelly,” “we,” “us,” or “our”) is operated by Bluebelly LLC, a Wyoming limited liability company. These Terms of Service (“Terms”) govern your access to and use of the Bluebelly mobile application, the Bluebelly website at bluebelly.app, and any related services (together, the “Service”).
By creating an account or otherwise using the Service, you agree to these Terms and to our Privacy Policy, which is incorporated by reference. If you don’t agree, don’t use the Service.
2. Eligibility and age requirement
You must be at least 13 years old to create an account or use the Service. If you are between 13 and the age of majority in your jurisdiction, you confirm that a parent or legal guardian has reviewed and agrees to these Terms on your behalf.
We do not knowingly collect personal information from children under 13. If we learn that someone under 13 has created an account, we will terminate it and delete the associated data as described in our Privacy Policy.
By using the Service, you also represent that you have the legal capacity to enter into this agreement and that your use of the Service complies with all laws applicable to you, including local fishing, diving, and wildlife regulations (see Section 8).
3. Your account
- You’re responsible for keeping your login credentials confidential and for all activity under your account.
- You must provide accurate information when you register (username, email) and keep it up to date.
- One person, one account. You may not create an account on behalf of someone else or impersonate another person or entity.
- We may suspend or terminate your account for violating these Terms, at our discretion, with or without notice (see Section 11).
4. The Service
Bluebelly provides:
- Conditions data — water temperature, swell, wind, current, water quality, tide, and related map layers for Southern California and Baja California coastal spots, sourced from NOAA, CDIP, and other public data providers.
- Social features — posting “catches” (photos with species, weight, and location), a feed, comments, emoji reactions, groups, following other users, and viewing other users’ profiles.
- Gamification — badges, leaderboards, and purchasable cosmetic Virtual Items (Section 7).
We may add, change, or remove features at any time without notice. We don’t guarantee the Service will always be available, uninterrupted, or error-free.
5. User content
“User Content” means anything you post, upload, or submit through the Service — catch photos, captions, species/weight/location data, comments, group posts, profile bios, and avatars.
You own your content. By posting User Content, you grant Bluebelly a worldwide, non-exclusive, royalty-free, sublicensable license to host, store, reproduce, display, and distribute it through the Service (for example, showing your catch photo in the feed, on a map marker, or on your public profile). This license ends when you delete the content or your account, except for content already shared with other users (for example, a comment someone else quoted) or copies kept in backups for a reasonable period.
You’re responsible for what you post. You represent that you have the rights to post your content and that it doesn’t violate anyone else’s rights or any law.
Prohibited content/conduct. You may not use the Service to:
- Post content that is illegal, fraudulent, harassing, hateful, sexually explicit, or that exploits or endangers minors.
- Post a catch that you know violates fish and game regulations, protected-species rules, bag/size limits, or marine protected area restrictions. Bluebelly is not a substitute for official regulations — see Section 8.
- Impersonate another person, post someone else’s photo as your own catch, or misrepresent where or when a catch occurred.
- Harass, stalk, or threaten other users, including through the follow, comment, or group features.
- Upload malware, scrape the Service, reverse-engineer the app, or interfere with its normal operation.
- Use the Service for any commercial purpose we haven’t approved (for example, running a guide-booking business through group posts without our consent).
Moderation. We may review, remove, or restrict any User Content, and suspend or terminate accounts, at our discretion, including for violations reported by other users. We’re not obligated to monitor content, and we’re not responsible for content posted by users.
Groups. Every group must be approved by Bluebelly before it’s visible or usable. We may reject or remove a group, or remove a group’s content, at our discretion.
6. Species badges and leaderboards
Submitting a catch for a species badge, or entering a leaderboard, requires that your submission accurately represent your own catch. We reserve the right to review, reject, revoke, or disqualify any badge, leaderboard entry, or submission we believe is inaccurate, staged, or submitted in bad faith, and to adjust leaderboard rules or badge criteria at any time.
7. Purchases and Virtual Items
Bluebelly’s core features — the conditions map, feed, posting catches, following other users, groups, and earning badges through real catches — are and will remain free.
We offer optional cosmetic Virtual Items for purchase or in-app unlock, including (now or in the future) custom emoji reactions, avatar skins, map marker skins, profile skins, and similar cosmetic unlocks. Virtual Items:
- Have no real-world monetary value, cannot be redeemed for cash, and cannot be transferred, gifted, resold, or exchanged between accounts except where we explicitly enable that feature.
- Are licensed to you for use within the Service, not sold to you — we retain all ownership rights in the underlying artwork and designs.
- Never affect gameplay mechanics, catch validity, badge eligibility, or leaderboard standing (“cosmetic-only” monetization — no pay-to-win).
- Are purchased through the Apple App Store or Google Play Store, whose own payment terms and refund policies apply. Bluebelly does not process your payment information directly and has limited ability to issue refunds outside of what the app store allows.
- May be modified, discontinued, or removed from sale at our discretion; we’ll make reasonable efforts not to remove Virtual Items you’ve already unlocked, but we don’t guarantee permanent availability if the Service itself is discontinued.
We may add new categories of Virtual Items over time without needing to update this section — “Virtual Items” is meant to cover any cosmetic digital good we offer, present or future.
8. Safety disclaimer — read this before you go in the water
Bluebelly is an informational tool, not a safety authority. Water temperature, swell, wind, current, water quality, tide, radar, and closure/advisory information on the Service is aggregated from third-party sources (NOAA, CDIP, RainViewer, and others) and may be delayed, incomplete, or inaccurate. Conditions in the ocean change quickly and can differ from what the Service shows.
- Do not use Bluebelly as your sole source of safety information. Always check official sources (NOAA marine forecasts, local lifeguard/harbor patrol advisories, Coast Guard notices) before fishing, diving, swimming, or boating.
- Fishing, freediving, spearfishing, and boating carry inherent risks, including drowning, decompression illness, marine life injury, and hazardous surf. You assume all risk when you engage in these activities, whether or not you used Bluebelly to plan them.
- You are solely responsible for complying with all applicable fishing/game regulations, licensing requirements, protected species rules, and marine protected area restrictions in the jurisdiction where you fish or dive (U.S. and Mexican waters have different rules). Bluebelly does not verify regulatory compliance of any spot, catch, or advisory shown in the app.
- To the fullest extent permitted by law, Bluebelly disclaims all liability for injury, death, property damage, or legal violations arising from your use of or reliance on conditions data, closure/advisory information, or any other content in the Service.
9. Third-party data and services
The Service displays data from NOAA, CDIP, RainViewer, and other public providers under their respective terms of use. We don’t control and aren’t responsible for the accuracy of third-party data. If a provider changes or discontinues its data feed, a related feature may stop working without notice.
10. Intellectual property
The Bluebelly name, logo, app design, and all software, text, and graphics we create (excluding User Content and third-party data) are owned by Bluebelly LLC or our licensors and protected by intellectual property law. You may not use our branding without written permission.
If you believe content on the Service infringes your copyright, contact us at legal@bluebelly.app with (a) a description of the work, (b) the allegedly infringing content’s location in the Service, (c) your contact information, and (d) a statement of good-faith belief that the use is unauthorized. We’ll respond consistent with the DMCA.
11. Termination
You may delete your account at any time through the app. We may suspend or terminate your access to the Service, remove content, or take other action if we reasonably believe you’ve violated these Terms, created risk or legal exposure for us, or if we discontinue the Service entirely. Sections that by their nature should survive termination (ownership, disclaimers, limitation of liability, dispute resolution) will survive.
12. Disclaimers and limitation of liability
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
TO THE FULLEST EXTENT PERMITTED BY LAW, BLUEBELLY LLC AND ITS OWNERS, EMPLOYEES, AND CONTRACTORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE IS LIMITED TO THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM, OR (B) $100.
Some jurisdictions don’t allow these limitations, so some of the above may not apply to you.
13. Dispute resolution — arbitration and class action waiver
You and Bluebelly LLC agree to resolve any dispute arising from these Terms or the Service through binding individual arbitration, rather than in court, except that either party may bring an individual claim in small claims court. You and Bluebelly LLC each waive the right to a jury trial and to participate in a class action or class arbitration.
14. Changes to these Terms
We may update these Terms from time to time. If we make material changes, we’ll notify you through the app or by email before they take effect. Continuing to use the Service after changes take effect means you accept the updated Terms.
15. Governing law
These Terms are governed by the laws of the State of Wyoming, without regard to conflict-of-law principles, without prejudice to any consumer-protection rights you may have under the law of your own state or country that cannot be waived by agreement.
